Terms of Service

These terms cover your use of this website. They are not the agreement for design or development work — that lives in a separate proposal and contract for each project. As with our privacy policy, we have tried to write this in plain English rather than the usual boilerplate.

Who we are

Elkin Studio (“we”, “us”, “our”) is a design and strategy studio based in Melbourne, Australia, operated by Glen Elkin trading as Elkin Studio, ABN 66 981 876 803.

“You” means anyone using this website.

What these terms cover

These terms apply to your use of elkinstudio.com.au and everything on it — the pages, the writing, the guides, the case studies and the contact form.

They do not govern client work. If we work together on a project, that engagement is governed by the proposal, quote and contract we sign for that specific project. Where anything in those documents conflicts with this page, the project documents win.

By using this website you accept these terms. If you do not accept them, please do not use the site.

Using this website

You are welcome to read, share and link to anything published here.

You agree not to:

  • use the site for anything unlawful, or in a way that breaches anyone’s rights
  • attempt to gain unauthorised access to the site, its server or its data
  • interfere with the site’s normal operation, including by scraping it in a way that degrades it for others, or by attempting to bypass any security measure
  • copy, reproduce or republish substantial parts of the site’s content as your own
  • misrepresent your identity or your relationship with us

We may restrict access to anyone who does these things.

What belongs to whom

Unless stated otherwise, everything on this site — the writing, design, code, photography, illustrations, the Elkin Studio name and the brand mark — is owned by us or used with permission, and is protected by copyright and trade mark law.

You may read it, quote it with attribution and a link, and share links to it freely.

You may not reproduce substantial parts of it commercially, remove attribution, or present it as your own work.

Client work shown in the portfolio remains the property of the clients it belongs to. It appears here as a record of work we did, with permission. Client logos and trade marks belong to those clients.

Guides, articles and other writing

The guides, articles and field notes on this site are general information. They are written from our experience and are not professional, legal, financial or technical advice for your particular situation.

Every business is different. Nothing here should be treated as a recommendation for your circumstances, and no relationship is created by you reading it. If a decision matters, get advice specific to you.

We try to keep everything accurate and current, but we do not promise the site is free of errors or that it will always be available.

Links to other sites

This site links to other websites and services we do not control. Those links are there because we think they are useful, not as an endorsement, and we are not responsible for their content, their practices or their privacy handling.

Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement.

If a consumer guarantee under the Australian Consumer Law applies to anything we supply, and we are permitted to limit our liability for a failure to comply with that guarantee, our liability is limited to resupplying the service or paying the cost of having it resupplied.

Subject to the section above, and to the fullest extent the law allows:

  • this website is provided “as is” and we make no warranties about it beyond those the law imposes
  • we are not liable for any indirect or consequential loss, loss of profit, loss of data or loss of business arising from your use of this site
  • we are not liable for the site being unavailable, or for any error or omission in its content

Nothing in this section limits liability that cannot lawfully be limited.

How we handle personal information is set out in our Privacy Policy, which forms part of these terms.

Changes to these terms

We may update these terms from time to time. The current version is always the one on this page, with the date it was last updated at the top. Continuing to use the site after a change means you accept the updated terms.

Material changes affecting an active project will be raised with you directly, not left to a page update.

Governing law

These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
